Temecula Domestic Violence Attorney
Direct Partner Representation for Domestic Violence Cases
Domestic violence allegations create urgent legal concerns for people requesting protection and those accused of abuse. Penna Ratajczak, LLP represents petitioners and respondents, with each client working directly with a partner throughout the matter. Because our practice is devoted exclusively to family law, we can address restraining orders alongside related divorce, financial, and custody concerns.
Michelle Penna, Attorney and Founding Partner, and Daniel Ratajczak, Attorney and Partner, bring substantial experience to these sensitive cases. Our firm has 90 years of combined experience, including more than 44 years devoted exclusively to this practice area, and has handled over 3,000 cases. We meet with clients at our Temecula office and provide focused guidance based on the circumstances before the court.

Emergency Protection & Restraining Orders in Temecula
If you’re in immediate danger, call 9-1-1. A responding law enforcement officer can help secure an emergency protective order, which provides immediate, short-term protection when the legal requirements are met. This emergency guidance is separate from retaining us for representation.
Under California Family Code section 6211, a domestic violence restraining order may be requested against:
- A current or former spouse
- A registered domestic partner
- A cohabitant or co-parent
- A dating partner
- A qualifying close relative, including a parent, child, sibling, grandparent, or in-law
A dispute outside these covered relationships may instead involve a civil harassment restraining order.
We can help Riverside County residents prepare and file a request for court protection. Riverside County Superior Court offers an online request portal and filing packets for cases with or without children. The DV-100 forms begin the process by identifying the parties, describing the alleged abuse, and stating which protections are requested.
A domestic violence restraining order may include:
- No-contact orders restricting direct or indirect communication
- Stay-away orders covering the protected person, children, home, workplace, or schools
- Move-out orders requiring a restrained person to leave a shared residence
Depending on the evidence, the court may issue a temporary restraining order before the hearing. Temecula-area cases are heard at the Southwest Justice Center in Murrieta. After both sides can present their positions, an order issued after the hearing may remain in effect for up to five years and may be renewed before it expires.
Legal Protection from Abuse, Harassment, or Threats
Our domestic violence lawyer can request court orders intended to protect clients from abuse, harassment, or threats. We help clients document the conduct, identify the protections they need, and prepare information for the court. When remaining in a shared home presents a concern, we can also request an order requiring the alleged abuser to move out.
These cases often intersect with broader family law proceedings. We address financial issues connected with the allegations and can file for divorce when a client wants to end a marriage to an abusive spouse. If children are involved, we can pursue measures addressing their safety.
Responding to Domestic Violence Allegations
A person served with restraining order papers shouldn’t ignore them. Riverside County provides an Answer to Domestic Violence Restraining Order form that allows a respondent to address the allegations and present relevant information. A judge can grant the requested order even if the respondent doesn’t attend the hearing, so a timely, carefully prepared response matters.
We represent people who maintain that they’ve been falsely accused. Our work can include determining whether the alleged act occurred, examining inconsistencies in the accuser’s account, and presenting records or other relevant evidence. When supported by the circumstances, we may also raise self-defense.
Some cases involve claims that an accuser manipulated the court process during a divorce or custody dispute. We assess that issue based on the available facts rather than assumptions about either party. We develop a factual response, explain the hearing process, and present the client’s position to the court.
Protecting Children & Addressing Parenting Arrangements
Abuse allegations can affect immediate safety and proposed parenting arrangements. When children are involved, the court may need information about parental contact, exchanges, residence arrangements, and the children’s exposure to the alleged conduct. Riverside County provides separate court-order packets for cases involving children.
We help parents identify concerns that must be raised in a restraining order or connected proceeding. For a parent requesting protection, that may include orders addressing a child’s safety. For a parent responding to allegations, it may involve evidence about the events and parenting arrangements under review.
Discuss Your Temecula Case Directly with a Partner
An initial discussion allows you to explain what happened, identify upcoming deadlines, and ask how the process may affect divorce, finances, or parenting arrangements. Because each case depends on its facts and evidence, we consider the circumstances before discussing potential legal steps.
Clients work directly with a partner from start to finish rather than being passed to associates or paralegals. This structure allows us to understand the allegations, prepare for the applicable court proceedings, and remain familiar with related issues throughout the representation.
